Acceptance of Terms

By accessing or using this website or mobile application (the “Site”) of BeAligned™ (the “Company,” “we,” or “us”), operated by The Layne Project, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, do not use this Site.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. The most current version of our Terms will govern. It is your responsibility to periodically review these Terms. Your continued use of the Site after revised Terms are posted constitutes acceptance.

The Site is intended for users who are at least 18 years old. Subject to these Terms, we grant you a limited, nonexclusive, non-transferable, revocable license to download the mobile application, if available, and use the Site.

Description of Service

BeAligned™ is an AI-powered guided reflection tool designed to help co-parents navigate conflict through a structured eight-phase process based on the BeH2O® methodology. The Service provides:

  • Guided AI reflections for co-parenting situations
  • Personal value and purpose discovery (Your WHY)
  • Multi-perspective exploration (Self, Co-Parent, Child lenses)
  • Collaborative option generation and action planning
  • Optional access to BeH2O® Certified Coach insights (Deep Think)

Informational Purpose Only

All content provided on this Site is intended for general informational purposes only. The information provided herein is not intended as and must not be interpreted as family counseling services or counseling from a qualified social worker or other qualified professional. The Site does not substitute for professional family counseling services or counseling from a social worker or other qualified professional.

No Professional Relationship

The BeAligned™ platform incorporates the BeH2O® methodology, developed by Trina Nudson. While Trina Nudson holds extensive professional credentials — including a Juris Doctor (JD), Licensed Bachelor of Social Work (LBSW), Certified Divorce Coach (CDC), Domestic Case Manager, Certified Mediator, Parenting Coordinator, and Guardian Ad Litem — your use of this Service does not create an attorney-client, therapist-client, or any other professional relationship with Trina Nudson or The Layne Project.

BeAligned™ is NOT:

  • Therapy or Counseling: The Service is a reflection tool, not a substitute for professional therapy, counseling, or mental health treatment.
  • Legal Advice: Nothing in the Service constitutes legal advice. The Service does not provide legal guidance regarding custody, divorce, or family law matters. Do not rely on it in lieu of a practicing attorney.
  • A Communication Tool: The Service is for personal reflection only. It does not send messages to your co-parent or any third party.

No Emergency or Crisis Services

This Site does not provide emergency or crisis services. If you are experiencing an emergency, call 911 or your local emergency number immediately. If you are in crisis or experiencing domestic violence, please contact the National Domestic Violence Hotline at 1-800-799-7233 or text START to 88788. Further, this Site does not provide legal advice or legal services. By using the Site, you acknowledge that you are using the Site and its services at your own risk.

Disclaimer of Liability

The content on this Site is for informational purposes only and does not constitute professional family counseling services or counseling from a social worker or other qualified professional. Always consult a qualified mental health professional, social worker, or attorney for your needs. Use of this Site is at your own risk, and the Site disclaims all liability for any actions you take or fail to take based on information provided here.

Use at Your Own Risk. You acknowledge and agree that your use of the Site is entirely at your own risk. The information, materials, and content provided are for general informational purposes only. We make no guarantees regarding the accuracy, completeness, timeliness, reliability, or availability of any content presented.

No Warranties.All content and services on this Site are provided “as is” and “as available,” without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we expressly disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company makes no warranties or representations about the accuracy or completeness of the Site and does not guarantee any specific results from use of the Site.

Jurisdictional Limitations. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Reflection Data Ownership & Control

Your reflections belong to you.BeAligned™ is designed to support reflective decision-making — not to create a public or shared record between co-parents. You retain full ownership of the content you create, and you may export or delete your data at any time.

By default, your individual reflection content is not shared with your co-parent, courts, or third parties through the platform unless you choose to share it or we are legally required to do so.

Users should understand that no digital platform can guarantee absolute confidentiality in all circumstances, particularly where legal obligations, subpoenas, court orders, mandatory reporting requirements, or safety concerns apply.

Acceptable Use

You agree not to:

  • Use the Service to harass, threaten, or harm anyone
  • Attempt to manipulate the AI system to generate harmful content
  • Use the Service for any purpose other than personal co-parenting reflection
  • Share your account credentials with others
  • Attempt to access other users' reflection data

Third-Party Links & Third-Party Information

This website may contain links to third-party websites or resources (for instance, but not limited to, articles, books, and other media) for your convenience and informational purposes only. Such third-party websites and resources are not under our control, and we are not responsible for the content, accuracy, reliability, or practices of any linked third-party site or resource. The inclusion of any link or identification of other resources does not imply our endorsement, approval, affiliation, or sponsorship.

You acknowledge and agree that your access to and use of any third-party websites or resources is entirely at your own risk. We make no representations or warranties regarding, and expressly disclaim any liability for, any third-party website or resource, including its content, accuracy, legality, or safety. You are responsible for reviewing the terms, conditions, and privacy policies of such third-party websites. Any terms, conditions, policies, or practices of third-party websites are solely between you and the third party.

Artificial Intelligence

As part of our Services, we provide access to an artificial intelligence (“AI”) tool designed to generate prompts, suggestions, and content based on the information and inputs you provide. By using this AI tool, you agree to the following:

  • AI Functionality: The AI tool provides prompts and content automatically, based on algorithms and the data you enter or select. Outputs are intended to support reflection but are not guaranteed to be accurate, complete, or suited to any specific need.
  • User Responsibilities: You are solely responsible for any use of the AI tool and for any content you generate, submit, or act upon. You must not use it for unlawful, harmful, or prohibited purposes, including generating illegal, offensive, discriminatory, or infringing content; using it in connection with medical, legal, financial, or other regulated advice except as expressly permitted; or relying exclusively on AI outputs for matters that could cause personal, professional, or financial harm without appropriate professional review.
  • Data Handling: All inputs and outputs may be logged and used to provide and improve the service, as described in our Privacy Policy. We do not permit third parties to use your data for training their own models without your explicit consent.
  • Limitations:AI-generated prompts are produced using probabilistic methods and may not always be available, accurate, or free from errors. The AI tool is provided “as is” without warranties of any kind, except as required by law.
  • Disclaimers and Indemnity:We disclaim all warranties regarding the AI content's fitness for any purpose. By using the AI tool, you waive any claim against us related to the accuracy or reliability of AI-generated prompts and agree to indemnify us for any claims arising from misuse.
  • Updates: We reserve the right to modify or discontinue the AI tool at any time without notice.

Research Participation

BeAligned™ partners with Arizona State University (ASU) for research on co-parenting conflict resolution. If you consent to participate, your anonymized and de-identified data may be used for research purposes. Participation is entirely voluntary and you may withdraw at any time without affecting your access to the Service.

Management of the Site

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms; (3) refuse, restrict, limit, or disable access to the Site in our sole discretion; (4) remove or disable files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Site to protect our rights and property and facilitate proper functioning.

Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, video, software, databases, design elements, compilations, trade dress, and other materials (collectively, the “Content”) — is the exclusive property of the Company or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws.

You may not copy, reproduce, republish, upload, post, transmit, distribute, display, perform, modify, adapt, create derivative works from, sell, license, or otherwise exploit the Content without prior express written permission. Without limiting the foregoing, you may not: (i) use Content in a manner that misrepresents ownership, sponsorship, or affiliation; (ii) scrape, mine, frame, or automatically harvest Content; (iii) use Content for competitive analysis or to develop a competing product; or (iv) remove or alter any proprietary notices. Any unauthorized use may subject you to civil and/or criminal liability.

Subscription & Payment

The Company accepts payment via third-party payment processors. Accepted methods may include credit cards, debit cards, and electronic transfers, as specified at checkout. All transactions are subject to authorization by the payment processor and issuing institution. By submitting payment information, you authorize the Company and/or its processor to charge the relevant method for the total amount, including applicable taxes and fees, and you agree to provide accurate billing information.

All payment details are encrypted and processed in compliance with the Payment Card Industry Data Security Standard (“PCI-DSS”). However, no method of transmission or storage is completely secure; you use these services at your own risk. The Company is not liable for losses resulting from payment processing errors, delays, or security breaches involving third-party processors, except as required by law.

Modifications to Terms

The Site reserves the right to modify these Terms at any time. Continued use of the Site after changes constitutes acceptance of the new Terms.

Termination

These Terms remain in full force while you use the Site. Without limiting any other provision, we reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Service (including blocking certain IP addresses) to any person for any reason or no reason, including for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law. We may terminate your use or delete content you posted at any time, without warning, in our sole discretion. Upon deletion, your reflection data will be permanently removed within 30 days.

If we terminate or suspend your account, you are prohibited from registering a new account under your name, a fake or borrowed name, or the name of any third party. We reserve the right to pursue civil, criminal, and injunctive remedies.

Indemnification

By signing up for the Site, you agree to release, indemnify, and hold harmless the Company and its respective officers, directors, trustees, employees, partners, members, managers, agents, affiliates, representatives, guarantors, subsidiaries, predecessors, assigns, successors, and heirs (collectively, the “Company's Indemnified Parties”) from any and all loss, damage, claim, action, expense, cost (including reasonable attorneys' fees), and liability brought by any third party arising out of: your breach or alleged breach of these Terms; breach of any third-party right, including intellectual property, publicity, privacy, or defamation claims; or your conduct resulting in personal injury, death, or property damage. You agree to cooperate in the defense of any such claim. The Company's Indemnified Parties reserve the right to assume exclusive defense and control of any matter subject to indemnification. You will not settle any claim without the Company's prior written consent.

Limitation of Liability

IN NO EVENT WILL WE OR ANY OF OUR OFFICERS, DIRECTORS, TRUSTEES, EMPLOYEES, PARTNERS, MEMBERS, MANAGERS, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — WHETHER IN CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER THEORY — INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT YOU PAID TO THE COMPANY IN THE THREE MONTHS PRECEDING THE DATE THE CLAIM AROSE, IF ANY. Some jurisdictions do not allow these limitations, in which case some or all of the above may not apply to you and you may have additional rights.

Governing Law

These Terms and Conditions, and any dispute arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. You agree that the state and federal courts located in Johnson County, Kansas shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. By using this Site, you consent to the personal jurisdiction and venue of such courts. If you access this Site from outside the United States, you are responsible for compliance with local laws.
