1. Introduction
Welcome to BeAligned™ (“the Company,” “we,” “us,” or “our”), a guided reflection tool for co-parents, operated by The Layne Project. The Company respects and understands your privacy (“you,” “your,” or “User”). This Privacy Policy describes how we collect your information through our mobile applications, website, and programs and networks we offer (collectively, the “Services”) and how we may use or share that information. This Privacy Policy should be read in conjunction with our Terms and Conditions. Access and use of our Services are subject to this Privacy Policy.
No Privileged Communication.The BeH2O® methodology was developed by Trina Nudson, who holds multiple qualifications including Juris Doctor (JD) and Licensed Bachelor of Social Work (LBSW). However, using BeAligned™ does not establish a professional relationship with her. Your reflection data is kept strictly confidential as outlined below, but it is not protected by attorney-client privilege, therapist-patient confidentiality, or any other legally privileged status.
2. Reflection Privacy — Our Core Commitment
Your reflections are private and are intended only for your personal use within BeAligned™.
BeAligned™ does not sell your reflection content, display it to other users, or use your individual reflections to publicly train AI systems. We do not share your personal reflection content with co-parents, employers, or third parties except:
- when you expressly authorize us to do so;
- when required by law, court order, subpoena, or legal process;
- or when necessary to protect safety, rights, or the integrity of the platform.
If we receive a legal request for your information, we will seek to protect user privacy to the extent legally permitted.
This tool is not intended for sharing mental health information. While we cannot control what you choose to share in the chat, we do not use or retain information for the purpose of creating records of mental health conditions.
3. Personal Information We Collect
Personal Information includes similar terms under applicable privacy laws — such as “personal data” and “personally identifiable information.” In general, it includes any information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual. Types we may collect include:
- First and Last Name
- E-mail Address
- Address for Payment Purposes
- IP Address
- Username / User ID
In addition, we collect and retain the reflections and entries you input into the Services and publicly available information about you, if any.
4. How Information Is Collected
When registering or filling out a form, or using the Services' chat feature, you may be asked to enter your name, address, e-mail address, phone number, and interests. You will be contacted in response to information you request.
Our Services may use first-party and third-party cookies, pixel tags, plugins, and other tools to gather device, usage, and browsing information. We use this for security, to facilitate navigation, and to personalize and improve your experience.
- Cookies are small text files transferred to your device to store and sometimes collect information about your usage (time spent, pages visited, language preferences, and other anonymous traffic data). You can control cookies via your browser or device settings; refusing them may affect the functioning of our Services.
- Pixel tags (web beacons, clear GIFs) may be used to track actions of users (including email recipients), measure marketing campaigns, and compile usage statistics.
5. How We Use Your Information
Any information we collect may be used to:
- Personalize your experience and better respond to your needs;
- Improve our Services based on feedback;
- Improve customer service and respond to support requests;
- Process transactions (your information will not be sold, exchanged, or transferred to any other company without your consent, except to deliver the requested product or service);
- Communicate with you (you may opt out of marketing communications at any time);
- Perform research and analysis for our business purposes; and
- Comply with our legal obligations or to prosecute or defend legal proceedings.
We may aggregate and anonymize Personal Information so that it is no longer reasonably capable of identifying any individual; such information may be used for any lawful business purpose.
6. Research Partnership
BeAligned™ collaborates with Arizona State University (ASU) for research on co-parenting conflict resolution. Any data shared for research purposes is fully anonymized and de-identified. No personally identifiable information is shared without your explicit consent. Participation is voluntary.
7. Data Security
We use reasonable measures to protect your Personal Information to minimize the risks of theft, damage, loss, or unauthorized access, disclosure, or use, taking into account the nature of the Personal Information. While we strive to meet prevailing industry data security standards, we cannot guarantee that our services and systems will always be immune from malfunction, unlawful access, breach, or other wrongdoing.
8. Data Retention
We keep your Personal Information only as long as necessary to fulfill the business-related purposes for which it was collected, unless otherwise required by law. AI communications between you and the Services are retained for 30 days unless we are required to retain them as described in this Policy; you may request deletion of AI communications by contacting us. We may retain certain Personal Information to comply with legal and tax obligations, to stop a terminated user from creating a new account, for legitimate interests (such as an outstanding claim or dispute), or to cooperate with law enforcement, a court order, or subpoena.
9. Disclosure of Personal Information
We may disclose Personal Information: to third parties who help us operate our platform and provide Services (e.g., administrative and technology service providers); to third parties with whom you choose to share information; to our affiliates and subsidiaries, and to any potential or actual acquirer or successor as part of any reorganization, merger, sale, or transfer of assets; and as required or permitted by applicable law, including to cooperate with law enforcement or a court order, to investigate or prevent wrongdoing, and to protect our rights and property.
10. Use of Artificial Intelligence
As part of our Services, we use artificial intelligence (“AI”) to provide functionalities such as recommending alternative phrasing or communication suggestions based on tone and language. Our use of AI is limited to enhancing your experience and delivering features you have explicitly requested.
We do not permit partners or third parties to use your personal information for training their own AI models. Any log or analytics data generated by your use may be used internally to improve our own Services. Where feasible, such data will be anonymized or pseudonymized. We do not use your personal data for profiling or automated decision-making with significant effects. You may request access to, correction of, or deletion of personal data processed by our AI features at any time, subject to applicable law.
AI systems are inherently probabilistic; outputs may not always be accurate, complete, or suitable for all circumstances. You are solely responsible for evaluating AI-generated output, using human review as necessary. No warranties are made as to the performance or accuracy of AI features, and your use is at your sole risk.
11. Children's Privacy
Our Service is not intended for anyone under the age of 18, and children under 18 are prohibited from using the Services. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 13, we will take reasonable steps to remove it. If you believe we have collected personal information from a child under 18, please notify us via the “Contact Us” section.
California Minors. If you are a California resident under 18 and believe your personally identifiable information has become publicly available through the Service and you are unable to remove it, you may request removal by contacting us. Please be specific about the information so we can find it.
12. Opt-Out Choice & Your Rights
You may opt out of marketing communications on a going-forward basis by contacting us or using the unsubscribe directions in each email. Under applicable privacy laws, you may have the right to review, amend, delete, or otherwise exercise rights over the personal information we hold, subject to legal limitations. To submit a request, email us as provided in the “Contact Us” section (we may need to verify your identity first). We will comply as soon as possible.
13. Third-Party Transfers or Services
This Privacy Policy does not apply to third-party services unrelated to our Services that we may link to. Any third-party website, application, or service has its own privacy policy or terms that you are responsible for reading and understanding.
14. Amendment of Privacy Policy
We reserve the right, in our sole discretion, to make changes to this Privacy Policy at any time. We will alert you by updating the “Last updated” date, and you waive any right to specific notice of each change. Your continued use of the Services after a revised Policy is posted constitutes acceptance.
15. Information for California Residents (CCPA)
Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), we provide the following details regarding the categories of Personal Information we collect, use, and disclose about California residents.
Sources. We collect Personal Information from our interactions with you (e.g., when you use our websites or applications, contact us, sign up for a newsletter, register an account, or purchase a service) and from our affiliates, third-party software providers, and publicly available online sources.
Categories collected (past 12 months). Category A (Identifiers); Category B (California customer-records personal information); Category C (protected classification characteristics, such as marital status); Category D (commercial information); Category F (internet/network activity); Category G (professional/employment information); Category K (inferences).
How we use it. To meet our service obligations; develop, improve, and maintain our products; provide services to our employees and agents; personalize and market our products; conduct research and analytics; and perform general business operations.
Disclosure (past 12 months). We may have disclosed Categories A, B, C, D, F, G, I, and K to third parties as described above. In the past 12 months we have not sold Personal Information, as “sale” is defined in the CCPA.
Your CCPA rights.You have the right to: know the personal information collected about you, its sources, and purposes; request the specific pieces collected; delete personal information collected from you; opt out of the sale of personal information (if applicable); non-discriminatory treatment for exercising your rights; and initiate a private cause of action for data breaches. 16. EEA Users (GDPR)
If you are located in the European Economic Area (EEA), your personal data is processed in accordance with the General Data Protection Regulation (GDPR). We collect and use your data only with a valid legal basis: your consent; performance of a contract; compliance with legal obligations; or our legitimate interests (where they do not override your fundamental rights).
You have the right to Access, Rectification, Erasure, Restriction, Objection, Data Portability, and to Withdraw Consent. We may transfer your data outside the EEA using safeguards such as standard contractual clauses. To exercise any right or raise concerns, contact us via the “Contact Us” section. You also have the right to lodge a complaint with your local Data Protection Authority.
